SOCIAL ELECTIONS AND RGPD: WHAT IS CHANGING

In view of the new legislation in force, Luxembourg employers can no longer submit a formal undertaking of compliance with the single notification decision of 14 September 2007 (Resolution No 108/2007 – social elections). Similarly, the prior formalities to be carried out with the CNPD are no longer required, but the obligations and principles arising from the General Data Protection Regulations (GDPR) and the law of 1 August 2018 must be respected by the data controllers.

The role of the data controller in these elections?

In the context of social elections, the controller – i.e. the employer or the head of the establishment in charge of organising these elections – must be able to demonstrate its compliance with the GPDR. as provided for in Article 30 of the Regulation, the controller must include all data processing operations in the register of processing activities. In this register, data processing operations in the context of social elections must also be included, specifying the name and contact details of the controller.
